TERMS OF SERVICE AND DIGITAL CONTENT LICENSE AGREEMENT

This Agreement is a legally binding contract between John Art Rock SRL, a company registered in Romania with registration number [J-Number/CIF], (hereinafter referred to as the “Company”, “We”, or “Us”) and you (hereinafter referred to as the “User” or “You”).

By purchasing, accessing, or using our video courses (the “Content”), you agree to be bound by these Terms.

1. DIGITAL CONTENT LICENSE

1.1. Upon successful payment, the Company grants You a non-exclusive, non-transferable, and revocable license to access the Content for personal, non-commercial use only.

1.2. This license does not grant You any ownership rights. All intellectual property, including videos, PDF materials, and proprietary methods, remain the sole property of the Company.

2. RESTRICTIONS ON USE (NON-DISTRIBUTION)

2.1. You are strictly prohibited from:

• Sharing your account login credentials (email and password) with any third party.
• Recording, downloading, or capturing the screen while viewing the Content.
• Distributing, selling, sub-licensing, or publishing the Content on any platform, including social media, telegram channels, or torrent trackers.
• Modifying or creating derivative works based on the Content.

2.2. The Company uses technical tracking (including IP monitoring and dynamic watermarking) to detect unauthorized sharing. Any violation will result in immediate termination of access without a refund and potential legal action.

3. REFUND POLICY (RIGHT OF WITHDRAWAL)

3.1. EU Consumer Notice: According to Article 16(m) of EU Directive 2011/83/EU (implemented in Romania via GEO 34/2014), the right of withdrawal (14-day refund period) does not apply to digital content provided on a non-tangible medium if the performance has begun with the consumer’s prior express consent and acknowledgment that they thereby lose their right of withdrawal.

3.2. By purchasing the course and accessing the video player, You expressly agree that:

• The Company will provide immediate access to the Content.
• You lose your right to a refund once the digital content is accessed, streamed, or downloaded.

3.3. Opening the video player, logging into the member area, or downloading any attached materials is considered “full performance” of the digital product.

4. PENALTIES FOR BREACH

4.1. In the event of unauthorized distribution, piracy, or commercial use, the User shall be liable to pay the Company liquidated damages in the amount of €5,000 (five thousand Euros) per violation, or the maximum amount permitted by law, whichever is higher.

4.2. The Company reserves the right to seek legal remedies under the Romanian Copyright Law, the US Digital Millennium Copyright Act (DMCA), and the UK Copyright, Designs and Patents Act.

5. LIMITATION OF LIABILITY

5.1. The Content is provided on an “as is” and “as available” basis. The Company does not guarantee specific results (financial, professional, or personal) from the use of the materials.

5.2. To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Content.

6. GOVERNING LAW AND JURISDICTION

6.1. This Agreement is governed by and construed in accordance with the laws of Romania.

6.2. Any disputes arising from this Agreement that cannot be settled amicably shall be subject to the exclusive jurisdiction of the competent courts in [Your City, e.g., Bucharest], Romania.

7. PRIVACY AND DATA PROTECTION (GDPR)

7.1. The Company processes your personal data (name, email, IP address, payment details) to provide access to the Content and to protect our intellectual property.

Prezentul Acord reprezintă un contract juridic între John Art Rock SRL, persoană juridică română, cu sediul în Str. Petre Ispirescu, Nr. 21, Mun. Bistrița, Jud. Bistrița-Năsăud, înregistrată la Registrul Comerțului sub nr. J06/1679/2022, CUI RO47126634, (denumită în continuare „Compania”) și utilizator (denumit în continuare „Utilizatorul”).

1. LICENȚA DE CONȚINUT DIGITAL

1.1. După plata integrală, Compania acordă Utilizatorului o licență neexclusivă, netransferabilă și revocabilă pentru a accesa conținutul video exclusiv pentru uz personal și necomercial.

1.2. Utilizatorul nu dobândește drepturi de autor asupra materialelor. Toate drepturile de proprietate intelectuală aparțin Companiei.

2. RESTRICȚII (NE-DISTRIBUIRE)

2.1. Este strict interzisă:

• Partajarea datelor de acces (user și parolă) cu terțe persoane.
• Înregistrarea ecranului, descărcarea sau copierea videoclipurilor.
• Distribuirea, vânzarea sau publicarea conținutului pe platforme de tip torrent, rețele sociale sau alte site-uri.

2.2. Compania utilizează metode de monitorizare tehnică (monitorizarea IP și watermark dinamic). Orice încălcare duce la suspendarea imediată a accesului fără rambursarea sumelor plătite.

3. POLITICA DE RESTITUIRE (RETRAGERE DIN CONTRACT)

3.1. Conform OUG 34/2014, Art. 16, lit. m), dreptul de retragere (returnarea banilor în 14 zile) NU se aplică pentru furnizarea de conținut digital care nu este livrat pe un suport material, dacă prestarea a început cu acordul prealabil expres al consumatorului.

3.2. Prin achiziționarea cursului și accesarea platformei, Utilizatorul confirmă că:

• Solicită furnizarea imediată a conținutului.
• Își pierde dreptul de retragere (restituirea banilor) din momentul în care conținutul video a fost accesat sau vizualizat.

4. POLITICA DE CONFIDENȚIALITATE (GDPR)

4.1. Operatorul de date

Operatorul datelor dvs. este John Art Rock SRL, CUI RO47126634, Email: [email].

4.2. Date colectate

Colectăm: Nume, prenume, adresa de email, adresa de facturare, adresa IP și date de navigare pe platformă.

4.3. Scopul și temeiul juridic

• Executarea contractului: Pentru a vă oferi acces la cursurile video de artă decorativă cu texturi sculptate care imitată piatra, stânca și alte texture naturale.
• Interes legitim: Pentru a preveni pirateria și utilizarea neautorizată (prin monitorizarea IP-ului și aplicarea watermark-ului pe video).
• Obligație legală: Pentru facturare și contabilitate conform legii române.

4.4. Drepturile dvs.

Conform GDPR, aveți dreptul de acces la date, rectificare, ștergere (în limitele legale fiscale) și dreptul de a vă opune prelucrării. Pentru exercitarea acestor drepturi, ne puteți contacta la [email].

6. EXONERARE DE RĂSPUNDERE (DISCLAIMER)

6.1. Scop educativ

Conținutul cursurilor de artă decorativă cu texturi sculptate care imită piatra, stânca și alte texture, este oferit exclusiv în scop educativ. Tehnicile predate constau în modelarea și sculptarea materialelor precum gips, mortar, ciment și alte compoziții pentru a obține efecte vizuale de piatră și stâncă. Rezultatele finale pot varia în funcție de abilitățile individuale și materialele utilizate.

6.2. Siguranță și sănătate

Utilizatorul este singurul responsabil pentru siguranța sa fizică în timpul utilizării uneltelor și materialelor (gips, rășini, solvenți, ciment, vopsele, etc). Recomandăm utilizarea echipamentului de protecție (mască, mănuși, ochelari).

6.3. Daune materiale

Compania nu este responsabilă pentru nicio daună cauzată pereților, structurilor sau altor bunuri materiale rezultate din aplicarea tehnicilor învățate. Recomandăm testarea oricărei tehnici pe o suprafață de probă.
